1. Scope and Acceptance
This Refund & Cancellation Policy applies to all products, services, and subscriptions provided under the brand "Phronesis" by Eligarf Enterprises, whether accessed via the website, applications, WhatsApp journeys, or any other channel.
By subscribing to or using any Phronesis service, the customer acknowledges that they have read, understood, and agreed to this Policy. This Policy forms part of the overall Terms of Service between the customer and Eligarf Enterprises.
2. Nature of Services and Evaluation Period
Phronesis provides tailor-made, configuration-heavy digital solutions for businesses, customized and implemented based on each client's specific requirements.
Before any paid subscription is activated, clients are given an opportunity to access and use the product for an evaluation period (including sandbox, pilot, trial, beta, or pre-go-live access) to assess suitability for their needs.
3. Subscription Start, Cancellation, and Non-Refundable Fees
Once a client confirms go-live/activation and the paid subscription is started on their request or continued usage, all fees for the active billing period (month, quarter, year, or custom term) become non-refundable.
A client may request cancellation at any time to stop future renewals. However, amounts already billed or paid for the current subscription term will not be refunded, fully or partially, except as expressly provided under the Technical Issues and Exceptional Refunds section below.
4. Technical Issues and Exceptional Refunds
Refunds are considered only where there is a material technical failure in the core service attributable to Eligarf Enterprises/Phronesis that:
- (a) substantially prevents the agreed use of the product, and
- (b) cannot be reasonably resolved despite the client's cooperation within a reasonable timeframe.
In such cases, clients must promptly contact their assigned Relationship Manager (RM) or write to support@phronesis.co.in with all relevant details. Eligarf Enterprises may, at its sole discretion and subject to applicable law, offer remedies such as issue resolution, service credits, pro-rata refunds, or other commercially reasonable solutions.
5. Exclusions from Refunds
Unless required by applicable law, no refunds will be provided for any of the following:
- change of mind or non-usage,
- continuation after evaluation period,
- one-time onboarding, setup, integration, consulting, or custom development once commenced,
- issues arising from third-party systems, networks, or integrations,
- client-side infrastructure issues, misuse, or non-compliance with recommended practices.
6. Process and Timelines for Requests
To raise any cancellation or refund request, the client must contact the assigned RM or email support@phronesis.co.in with:
- account details,
- transaction reference,
- description of the issue,
- supporting evidence/screenshots.
All requests are reviewed on a case-by-case basis. Eligarf Enterprises reserves the right to approve or reject any request in accordance with this Policy, applicable law, and obligations towards payment partners.
7. No Guarantees and Limitation of Liability
This Policy does not create any additional warranty or guarantee beyond what is expressly stated in the applicable Terms of Service, order forms, or agreements between the client and Eligarf Enterprises.
To the maximum extent permitted by law, any refund or service credit granted under this Policy will be treated as the client's sole and exclusive remedy for the issue in question. Eligarf Enterprises' aggregate liability will be limited as defined in the limitation-of-liability provisions of the Terms of Service.
8. Policy Changes
Eligarf Enterprises may modify or update this Refund & Cancellation Policy from time to time to reflect changes in business practices, legal or regulatory requirements, or payment-partner rules. The updated version will apply to all new transactions after its effective date.
Continued use of Phronesis services after such updates will be deemed acceptance of the revised Policy. Clients are encouraged to review this Policy periodically.
